Litigation & Dispute Resolution

Osh Legal has a strong focus on litigation, arbitration and strategic dispute resolution, representing clients before courts, tribunals, regulatory authorities and arbitral tribunals. We advise and represent clients at both the pre-dispute and post-dispute stages, with an emphasis on commercially sound strategies, effective advocacy and timely resolution.

Our Practice Areas

1. Tax Litigation

We advise and represent clients in direct and indirect tax disputes, including assessments, investigations, adjudication, appeals and proceedings before appropriate appellate forums and courts. Our approach combines substantive tax expertise with focused litigation strategy.

2. Arbitration Matters

Our arbitration practice covers pre-arbitration strategy, invocation, interim relief, pleadings, evidence, hearings, cross-examination, settlement and enforcement or challenge of arbitral awards.

We advise on both domestic and international commercial arbitrations and proceedings under the Arbitration and Conciliation Act, 1996, including matters under Sections 8, 9, 11, 14, 34 and 37.

3. Commercial Dispute Resolution

We represent clients in complex commercial and corporate disputes before High Courts, NCLT/NCLAT, DRT/DRAT, regulatory authorities and other statutory forums.

Our experience encompasses contractual and shareholder disputes, corporate and insolvency litigation, debt recovery, banking and finance disputes, SARFAESI matters, tax disputes, fraud and regulatory proceedings, intellectual property disputes and property-related litigation.

4. Insolvency & Stressed Asset Disputes

We advise creditors, resolution applicants, investors and other stakeholders on disputes arising from insolvency proceedings and stressed-asset acquisitions, from acquisition strategy and documentation through implementation and subsequent litigation.

Our practice also covers creditor proceedings, settlement strategies, disputes involving Resolution Professionals and contentious issues arising under the Insolvency and Bankruptcy Code, 2016.

Our Approach

Our approach is strategic, commercially informed and dispute-focused. We seek to understand the client’s business objectives, contractual position, financial exposure and regulatory environment before determining the appropriate course of action.

Where appropriate, we pursue negotiation, mediation and settlement alongside litigation or arbitration, while remaining prepared for decisive representation before the relevant forum.

Our integrated corporate, tax, insolvency and regulatory expertise enables us to address disputes not merely as isolated legal proceedings, but as part of the client’s broader commercial strategy.

Our Objective

To provide focused, commercially aligned dispute-resolution strategies that protect our clients’ legal and business interests while pursuing effective and sustainable outcomes.
