Osh Legal advises and represents businesses, financial institutions, individuals and other stakeholders in matters concerning negotiable instruments, cheque dishonour and related recovery and criminal proceedings. Our practice combines preventive advisory with strategic representation in disputes under the Negotiable Instruments Act, 1881, with BNS and BNSS applying to connected criminal-law issues, where applicable.
Our Practice Areas
1. Cheque Dishonour & Section 138 Proceedings
Advising and representing clients in cheque dishonour matters, including statutory notices, complaints, defence, evidence, interim compensation, compounding and appeals. Section 138 provides the statutory framework for dishonour of cheques issued towards legally enforceable debts or liabilities.
2. Negotiable Instruments Disputes
Advising and representing clients in disputes concerning cheques, bills of exchange, promissory notes, endorsements, guarantees and related contractual liabilities, including recovery and enforcement proceedings.
3. Criminal & Ancillary Proceedings
Representing clients in connected proceedings involving BNS and BNSS, including allegations of fraud, cheating, forgery or other offences arising in connection with financial and commercial transactions, where applicable.
4. Recovery & Settlement Strategy
Advising on pre-litigation recovery, demand notices, settlement and mediation, as well as pursuing appropriate civil and criminal remedies concurrently where legally permissible.
Our Approach
Our approach is commercial, time-sensitive and resolution-oriented. We carefully assess the underlying transaction, enforceability of the liability, documentary evidence and statutory timelines before determining the appropriate strategy.
We focus on effective recovery, strong defence and efficient resolution, whether through settlement, mediation or litigation.
Our objective is to help clients protect their financial and legal interests while pursuing timely and commercially practical solutions to negotiable instrument disputes.
